Stallion Service Agreement - Zippo Can Do - Lawence Quarter Horses & Helland Ranch

No.____________ Mare Owner: __________________________________________________________ Stallion: Zippo Can Do   -   AQHA Registration #3297244 Stallion Owner: Lawrence Qtr Horses, 23552 Hwy 316 Blvd, Hastings, MN 55033, 651·438·4123 Breeding Farm: Helland Ranch, 22633 Vista Road, Hutchinson, MN 55350, 320·587·8086 Season of Service - February 1 to July 1, 2002   -   Mare Care paid to Helland Ranch Breeding Fee for Live Foal $1500 paid to Lawrence Quarter Horse Farm
1.	Mare Owner hereby contracts with Stallion Owner for one service of the Mare during the season stated above, for the above quoted fee. The breeding fee includes a non-refundable booking fee of $200.00 payable with this contract, balance of which must be paid when mare is picked up. The service will occur at the breeding Farm.
2.	A photocopy of Mare's Registration Papers must be delivered to Breeding Farm Prior to, or no later than delivery of Mare to Breeding Farm. Breeding Farm or Stallion Owner reserves the right to request registration papers and health papers in advance of Mares delivery. Breeding Farm or Stallion Owner may at their option complete additional health testing, if deemed necessary, at Mare Owner's expense.
3.	Mare must be halter-broke, healthy and in sound breeding condition.
4.	A. Live foal guarantee: This guarantee is conditioned upon compliance by Mare Owner and Mare of all conditions set forth in this Agreement and applicable horse breeding customs.
	B. "Live Foal" means that the Foal shall stand and nurse. If the Mare dies, proves barren, aborts her Foal or if Foal is stillborn, a return service will be provided the "following season" but only if Mare Owner had complied with this agreement and provided satisfactory evidence.
	C. Breeding Farm agrees to diligently try to settle the Mare, and shall have sole and absolute discretion in determining best method to accomplish breeding.
	D. If Stallion dies or becomes unfit to breed before Mare is bred, Stallion Owner and Breeding Farm shall have no liability to Mare Owner except to notify Mare Owner of occurrence, and refund booking fee and/or stud fee.
5.	A Breeders Certificate will be issued to Mare Owner after all fees and expenses due Stallion Owner and Breeding Farm have been paid, in full, and upon notification of birth of Foal and entitlement to issuance of certificate.
6.	Waiver of Liability: Stallion Owner, Breeding Farm, and Breeding Farm's owner, employees, agents, guests, veterinarian, etc. shall not be liable or in any way responsible for any injury, or damage to Mare, Mare escape, disability or death at Breeding Farm. Mare owner will not be liable to Breeding Farm for damages or injury, or death of an animal at Breeding Farm unless Mare Owner has failed to advise Breeding Farm, in writing, of dangerous nature of Mare or other like unusual circumstances creating higher than usual risk.
7.	In addition to breeding fee, Mare Owner will pay all expenses incurred at Breeding Farm, for Mare and Foal. A $50.00 fee will be charged for any return checks. If collection proceedings are required, Mare Owner will be responsible for attorney fees and costs incurred by Stallion Owner or Breeding Farm. Breeding Farm retains lien on Mare and Foal until payment in full.
8.	Miscellaneous items: This agreement shall be interpreted under the laws of the State of Minnesota. This Agreement may be executed in counterparts and will be effective when at least one copy has been executed by Mare Owner, by Breeding Farm, or Authorized Agent. Any charges in the Agreement are to be in writing and signed by Breeding Farm or Authorized Agent, and Mare Owner or Authorized Agent.
